Description

The project addresses the challenges facing Bulgaria related to the insufficient awareness and application of the provisions of the European Convention of Human Rights (ECHR). The project aims to contribute to the efficient implementation of the international human rights standards in legislation and case-law. The project will raise the awareness of the target group and improve the case-law, the quality of the adopted legislative acts and the quality of law education and the place of human rights in it. First, the national legal framework and case-law on human rights will be reviewed. Second, 10-15 strategic cases will be filed to challenge structural issues in the Bulgarian case-law. Third, a monthly news bulletin on human rights will be disseminated. Finally, recommendations will be issued on the place of human rights in Bulgarian law education. The project will benefit the target group of members of the legislature and the executive power.

Summary of project results

The need of the project can be seen in assisting the national law and the judicial case law to be in compliance with the European Convention on Human Rights (ECHR) and thus stop repeated violations of fundamental rights and freedoms. To achieve the expected outcomes, the following activities were carried out and the following outputs were developed: 1) 18 newsletters on human rights with judgments of the European Court of Human Rights (ECtHR) and the Court of the EU (CEU); 2) 18 legal opinions addressing human rights protection issues. The grounds presented were addressed, discussed and accepted as part of the opinions enclosed to 5 constitutional cases and 2 interpretation cases of the General Assembly of the Civil Division of the Supreme Court of Cassation (SCC); 3) amendment to the Civil Registration Act with regard to stillborn babies who have been so far treated as biological waste; 4) pending amendment of the Penal Code of Proceedings (PCP) and our reasoning was included in the summarized material and will be discussed by the decision-maker; 5) 14 opened strategic cases addressing different human rights protection issues; b) a comparative analysis of teaching human rights in Bulgaria and in several foreign universities. The project activities helped promote democratic values via human rights protection and enhance the safeguards for compliance with human righst in Bulgaria. International human rights protection standards brought to the attention of decision-making authorities helped the legislature, the ruling of interpretative judgments and court judgments and played important role to prevent violations when issuing judgements in compliance with human rights standards and thus helped the project achieve its impact on the target groups.
